Ebay vs LVMH

 

We are all been familiar with Ebay, the modern day form of an auction house. A new form of bringing auction into the internet, which enable people from all over the world to participate of each auction that were held at the time. Unlike the traditional auction house like christie’s, in Ebay you could basically sell anything and it is not has to be high end and expensive, it could be something small and worthless. Ebay, did not restricted the sellers specifically, even thought still sets some “ground rules”. Those rules are including, obligation for sellers and buyers, limitation, and prohibition of counterfeit.

Apparently, the rules that are set by Ebay were not enough to prevent of selling fake stuffs in Ebay. As, in the online world it is certainly easy to manipulate such things and to obey the policy sets by Ebay is very easy. That later makes Ebay popular as a place for people selling fake branded goods. Off course companies such as LVMH (Louis Vuitton Moth Hennessy), Tiffany & Co, and Christian Dior are aware with their losses, the trespassing of Intellectual Properties counterfeit, which their products are the subjects of it. They later filed their case to French and US court, suing Ebay for not giving enough effort to prevent counterfeiting. Of course, LVMH won the case and 16.4 Million Euro but is it Ebay the right party to sue? Ebay, as I read have set the policy quite clear (took quite a time to only skim read it) and Ebay is only participating in the trade as the third party. It is like annie is selling pasta in pim, turns out her pasta is poisoned! Someone is sick because of eating her pasta and he decided to sue pim for letting Annie selling pasta, even though Pim already set a policy that said everything sells there should be save for the costumers and Pim is not responsible with any further damages.

LVMH wins over Ebay, could be viewed as both relevant and irrelevant. Ebay as a liable media of selling should be aware with not only costumer care (both seller and buyer) but also the other party in this case brand rights owner, and should be more hands down on each transaction. While in reality Ebay seems hand off and only acting as a media that is taking capital advantages and left off their obligations. It’s like their failure not only to the third party but also to the buyers, because not everyone expect goods they purchases in Ebay is fake there are peoples that expect it to be original. So in this case Ebay clearly also obeying their costumer rights, and off course if we relate to this their failure to prevent counterfeit not only the losses of the brand owner. This results to their LVMH wins over Ebay is well deserves.

On the other hand, I believe Ebay thinks it’s out of their hands. They have tried to prevent the counterfeit by their quite strict policy, even thought it is not hard to find a slack out of it, and they basically like the other market! Ebay is just a media of selling things, and clearly they are not the seller. Since it is located in the Internet, which basically anything can happen and you should not expect something runs smoothly and in line with the law all the time. Ebay’s policy is also quite twist and turn, basically says that they are not responsible with anything that are purchased and sold in Ebay, and since its legalized and valid it their right to do so. Then, it makes LVMH’s case over Ebay is irrelevant.

Personally, I think the ruling is already suitable because making a twist and turn policy is also inappropriate even thought it is not completely wrong. Many corporations do made that sort of thing (even almost every corporation I supposed). I have not read really that much about this case personally, but really I need to be a little something just to brush up my minds.

well, actually i am not heading anywhere this holiday. BUT at least a little break of those burden of studying and stuff would be really great.
anyway... I came to realize that cesc fabregas is even gets more and more perfect all the time.
1. He just made captain 3 weeks ago
2. He is totally humble
3. He has been with his gf for 5 years! since he first arrived in london
4. He seems really sweet to her, always praising her, and his gf is definately not a typical wag which I really appreciate from him not choosing a typical fame chasers non working wag as his partner
5. He's quite mature for his age (21, sometimes we forgot how old is he)
6. and in the same time, he is still maintain his "todly attitude", and somehow it is very cute......
7. well, he did earn 100,000 pound a week

really, if oneday i could find a guy like him...... I promise myself to love that guy jajajajajaja

Then... I've submitted some college application
1. NUS- in process
2. UCL (really-really really wanna go there so bad)- acknowledge, need to complete the test, and interview
3. King's College London-acknowledge, will know the outcome by mid january
4. Queen Mary University of London-sent
5. SMU- waiting for my SAT score to come out.....

basically, i am most likely to move to london which is... WOW!

TRY OUT IS COMING



TRY OUT FOR THE NATIONAL EXAMINATION IS COMING AND I AM TOTALLY UNPREPARED. juder

We have this try out thing for 7 times until the actual examination and i am going to face the first one later this week. It consist of six subjects, indonesian language, math, english, geography, sociology, and economics and believe me, i am totally unprepared. I've tried to study, but IDK it's just doesnt work out so well. I am so not in a mood to study and so in the mood for DVDs jajajajaja
ever since i am taking SATs and stuff i have been "left behind" with all the tv series i watches like Dirty sexy money, ugly betty, gossip girl, and lots others. THANKFULLY i finally get a change to catch up jajajajaja

Last week wasnt so bad, except for all the conflicts in school with those PMS-ing teachers. I could relax a bit after all those SATs madness which i probably sux in and still wating till 20th of november for the result (god its killing me). Good thing coming up too, arsenal won yesterday from MU jajajajajajajajaja

ANYWAYYYY, few weeks ago i've written something about places i  might live in next year....
and i could cut all the US cities from those list cause suddenly my mom wont let me apply to US even if i got a scholarship.
That'll make other than singapore..... I'll be heading to UK(maybee) or stay here (hell no please god no dont let me)
sooo wtv... I have to face this fan-freakin' try out thing and to start to actually STUDYING AGAIIN

speaking about death penalty....



Currently, the newspapers other than talking about the US election also been talking about the upcoming execution of amrozi the bali bombers... so here is my opinion about death penalty. I have written this around 4 months ago so anyway... here it is


Honestly, I'm not really sure with my point of view of the existence of death penalty. I haven't exactly made up my mind whether I'm agreed or disagree with the practice of capital punishment or death penalty. In some cases, I could say that capital punishments are compulsory but, in other case it could be unnecessary.

It is true that capital punishment could make our lives more secure and could decrease criminal acts in the society but, there are some cases where the decision to give death sentence to the criminal suspects are not consider very well enough. For example, there was a case where the main suspects is an alibi of the real criminal but, without an extensive investigation the 'fake suspect' was punish with death penalty for a crime he did not commit. This kind of situation happened a lot within cases, and then by the time the court found out about the real situation the death sentence that was given would be regretted.

In the other hand, there are also many other cases where capital punishment should be given but in the reality not given to the criminal. This situation should not be happening and it is one of the proofs of an ineffective law. This situation is also an example of investigation failure.

Capital punishment or death penalty should be given to people who committed 'heavy crime' such as mass murders, serial murder, terrorism, rape, war criminals, corrupts, and drugs criminals (especially huge dealer). Those people are extremely dangerous to the society, and their crime cannot be forgiven. But, their cases should still need an extensive investigation so the punishments that will be given to them are equal to the crime they committed.

Even so, in many countries there are still law systems that not allowing death penalty to be given to criminals and there are also controversies among religious views and other social views about this issue. In short, death penalty should be considering case-by-case and only given to people who really deserves it.

A busy week



So, this week I've been burden by many things to do in which makes me so fan-freaking TIRED. Owh damn.....
Plus, SATs coming up 2 weeks from now which I need to study SUPER HARD.

So anyway, I have a little "get away" from all those busy-ness and anything that has to do with my future that is watching football
(seriously) even you might think I am not a football watcher kind of person.
Last night, I actually watch 2 match and a half (3 actually) which are,
liverpool vs wigan (3-2),
arsenal vs everton (3-1, I kept praying during the kick off --->i watched the delayed though, so I've known the score and who's scored but i get to see cesc fabregas ugly hair thought jajajajaja)
and the half of the madrid derby (2-1,but I was too sleepy to watch till the end)

Speaking of SAT, I need to achieve at least 1900, while even americans find it very difficult and I havent build that so called "impressive vocabulary" and there are many things that are still need to be improve and honestly I don't think 2 weeks is enough for me.

the advantages of being garralous

Some people have problems with expressing their minds and say it out loud, but some others could find it very easy.
This topic is actually quite cliche, but somehow I found it quite important to discussed too.
People's ability to express their thoughts came from their roots. What I meant by roots is how they educated and how well they were raised too.

In mostly third world countries, people seems to be not as eloquent as they supposed to be. Many people do have problems in expressing their minds. It is because, in school they are not taught well about the importance of speaking their minds and sometimes during class, and even some teacher could not allowed any critics from their students. Other than that, some parents also did not want to be criticized by their kids. These conditions would cause someone not adapt to the free speech minds and not used to expressing their thoughts.

So, what are the advantages of being garralous?
1. Be heard by others
2. The more we talk and speak up the more we could explore our strength
3. Not feel burden by our problems
4. Everyone could see our abilities
5. Easily get what we want
6. and many of others...

That is why, ability to expressing our thoughts must be well developed eventhought too much speaking would not be good too but a decent amount of speaking would do so much to our live.

3. New Haven (yeaaahhh riteee)

(+) seems to be a very good place to study, again its cold, located in east coast
(-) very far far away from home, I dont really know much about this place (completely new for me), I need to get in to yale which is.... very very very very damn hard

7. Warwick

the county town of Warwickshire, England. The town lies upon the River Avon, 18 km (11 miles) south of Coventry and 4 km (2.5 miles) west of Leamington Spa, with a population of 25,434 (2001 census).
(+) seems like a good place to study, decent place to live, I could major in law since the foundation year
(-) i am totally clueless about this place

the glory hunter



Human, in fact have their natural will to chase a certain glory in their field of experties. This willingness is something applies on almost normal people life.
The Glory Hunter, that's what people are.
People almost always wants to be the best and tried to get to the top of the game. Sometimes, people with lack of morality will try to legalize anything to get to the top and this is eventually will lead to disadvantages for others or crushing people in the "lower tier".
In this case, I'd like to talk about the government and "those people above us" . In Indonesia, getting to the top of the government body has to be done with unfortunately quite "sadistic" way. It is either with destroying the rival's credibilities or using other ways like money and taking advantages from others unluckiness.
Well, that's what every politician does, that's why it is called politic, tried to get to the top.
I have been observing how politician in this country been work their way to the top, and those practical sadistic way are sadly mostly used by them.
they use money, so less fortunate people would vote for them, then making bad publicity about their rivals and we can see how those illegal and inappropriate methods they've been using these days.
Why do I refer using money as sadistic way to get to the top? well firstly, it is also one of the way to exploits the less fortunate with for "the big guy" personal gain and second, it ruined the objectivity of voters.

Well, glory hunters, we are all glory hunters
above are the picture of the "bad" glory hunters but, actually not everything relating to glory hunter is really that bad. There are some positive ways to get to the top, with stay on our morality and focusing on our qualities. As for the future, i wish that "those people above" would get back to their morality and actually "there" for the goods of others and this country. Not for their personal gain

SERIOUSLY? I AM VERY VERY NERVOUS ABOUT SAT AND THE WHOLE COLLEGE APPLICATION CRAP

life as high school senior = too much responsibility
1. To pass the national examination crap (math, english, bahasa indonesia, geography, sociology,economics)
2. find a GOOD college
and
in this case 
i decided to only applying to top 250 university all over the world

Which is very very very selective
so here i am applying to 6 to 8 universities all over the world and wait for anything god will decide to take me......
3. To maintain my grades in school
4. Making the best time of my last year in school

soo..... wish me luck
